Organiser Refund Policy Requirements

This document is part of a set forming our Terms and Conditions.


1. Refund Policies and Administration

1.1 Minimum Requirements.

We understand that refund policies vary depending on the type of event and the Organiser. Because of that, we provide flexibility for Organisers to post their own policies with respect to their events, so long as they meet the following minimum requirements:
1.1.1 Refund policies must be posted on the applicable event page;
1.1.2 “No refund” policies are permissible, but must be clearly identified as such and must otherwise comply with these minimum requirements;
1.1.3 Refund policies (including “no refund” policies) must provide for a refund or other make good for complete failure to provide the advertised goods and services (e.g., event cancellation);
1.1.4 Refund policies must be in accordance with all applicable local, state, provincial, national and other laws, rules and regulations, including all requirements imposed by Card Schemes or Alternative Form of Payment Frameworks (each as defined in the Merchant Agreement);
1.1.5 Refund policies must include specific instructions on how to obtain a refund, including how, when and where to direct a refund request;
1.1.6 Refund policies may not be changed with respect to purchases made prior to the date of such change and its posting to the applicable event page;
1.1.7 Refund policies must set out a specific time frame within which refund requests will be responded to, which should not exceed five (5) business days for a first response; and
1.1.8 Refund policies must otherwise be fair and reasonable.
1.1.9 If a refund policy is not posted or does not meet these minimum requirements set forth above, LIVE IT Group may (but has no obligation to) modify such refund policy such that it meets these minimum requirements. Such modification may take the form of prospectively making changes to the Organiser's posted refund policy on the applicable event page or retroactively applying such changes at the time of a dispute, chargeback and/or refund request.

1.2 Refund Process.

In order to initiate a refund request, an Attendee should contact an Organiser directly as set forth in the applicable refund policy. If no contact information is listed, the Attendee should use the contact the organiser button on the event page or such other information posted on the event page. Organiser agrees to administer its refund policy in accordance with the terms set forth on the applicable event page and the minimum requirements set forth in Section 1.1 above. When an Attendee has requested a refund and the Organiser does not respond by either refunding or denying the request after seven (7) days, LIVE IT Group may execute the refund on behalf of the Organiser.

1.3 LIVE IT Group Review.

In the event that Organiser fails to honor a refund that an Attendee believes is due under the applicable refund policy and/or the minimum requirements set forth above, that Attendee may request that LIVE IT Group initiate a refund by contacting us. LIVE IT Group will review the facts and circumstances and determine whether or not a refund is due in accordance with the applicable refund policy and the minimum requirements set forth above. LIVE IT Group will endeavor to complete its review within thirty (30) days of being contacted by Attendee. Attendees should note that if an Organiser has selected a facilitated payment method such as PayPal® or Stripe® for an event, LIVE IT Group will not have control of the funds and LIVE IT Group will need the provider of the facilitated payment method to cooperate in order to obtain a refund, which may not happen. All determinations of LIVE IT Group with respect to these Refund Policy Requirements, including without limitation the orders to be refunded and the size of any refund, shall be final and binding on both Organiser and Attendee.

1.4 Facilitated Payment Methods.

Organisers can use Facilitated Payment Methods (FPM) such as PayPal® or Stripe®. If an FPM is used the LIVE IT Group has no control or oversight over the payment and both the Organiser and Attendee wholly indemnify LIVE IT GROUP from any financial losses, disputes, service disruptions or any other adverse issue caused by the use of the FPM.

2. No Insurance or Guarantee

These Refund Policy Requirements are not intended to be and do not constitute an offer to insure the performance of or to guarantee the performance of any Organiser and are not a guarantee that refunds will be issued in any given situation.

3. Booking Protect

Refund Protection is provided by Booking Protect®. Refund Protection is an option that can be added to a booking at the ticket purchaser's discretion. Refund Protection provides cover for the non-attendance of an event according to the terms and conditions outlined at http://bit.ly/1sVNi3X (bookingprotect.com). Refund Protection does not cover the purchaser if an Event is cancelled by the Organiser. Booking Protect is not part of LIVE IT Group and by purchasing Refund Protection the Buyer is agreeing to the Terms and Conditions of Booking Protect and are entering into an agreement exclusively with Booking Protect. Booking Protect fees are non-refundable.

4. Event Protect

Event Protect is an event cancellation insurance provided by Event Protect Ltd.
If Enabled for the event then if the event were to be cancelled as per the terms and conditions of Event Protect, which can be found here: https://www.eventprotect.co/EventProtectStandard, then the customer can claim their refund for their ticket costs directly from Event Protect.
It is the organiser’s responsibility to alert LIVE IT Group that their event could be cancelled and then it is LIVE IT Group who will inform ticket buyers on how to claim their refund via Event Protect.
If the cancellation doesn’t fall under the Event Protect terms and conditions than any refunds are the sole responsibility of the organiser.
Both the Organiser and Attendee wholly indemnify LIVE IT Group from any financial losses, disputes, service disruptions or any other adverse issue caused by the organiser cancelling the event which isn’t covered by Event Protect due to failure to meet the Event Protect terms and conditions.
